Terms of Use & End User License Agreement

Mulhim provides technology-based sports, fitness, training, nutrition, wellness, and performance tools.

Depending on the version of Mulhim and the features available to your account, the Service may include:

• AI-generated training plans and recommendations.
• Workout and exercise tracking.
• Computer vision-based exercise and movement analysis.
• Exercise repetition and technique feedback.
• Nutrition and meal-related recommendations.
• Progress and performance insights.
• Wellness, sleep, recovery, and lifestyle-related insights.
• AI-powered conversational features.
• Personalized recommendations based on information provided by the user.
• Other sports, wellness, fitness, nutrition, and performance features introduced by Mulhim.

We may introduce, update, improve, modify, limit, replace, or discontinue features as the Service develops.

Mulhim is intended for sports, fitness, wellness, educational, and informational purposes.

Mulhim does not provide medical diagnosis, medical treatment, emergency medical services, or professional medical advice.

Training plans, nutrition recommendations, AI-generated responses, exercise feedback, computer vision assessments, wellness insights, and other information provided through Mulhim are not substitutes for advice from a qualified physician, physiotherapist, dietitian, nutrition professional, certified trainer, or other appropriate professional.

You are responsible for determining whether an exercise, workout, training program, nutrition recommendation, or other activity is suitable for you.

You should consult an appropriate healthcare professional before starting or materially changing an exercise or nutrition program if you have an injury, health condition, physical limitation, pregnancy, unusual symptoms, or other health concerns.

You should immediately stop exercising and seek appropriate medical assistance if you experience symptoms such as severe pain, chest pain, fainting, significant dizziness, unusual shortness of breath, or other concerning symptoms.

Mulhim must not be used for emergency medical situations.

Certain Mulhim features use artificial intelligence, automated analysis, machine learning, computer vision, or related technologies.

AI-generated information may occasionally be incomplete, inaccurate, inappropriate, or unsuitable for a particular individual or situation.

Mulhim does not guarantee that AI-generated recommendations, predictions, nutrition suggestions, training plans, exercise assessments, technique evaluations, or other automated outputs will always be accurate or error-free.

Users are responsible for applying reasonable judgment before acting on AI-generated information.

Mulhim must not be relied upon as the sole basis for medical, health, safety, or other high-impact decisions.

You are responsible for:

• Providing accurate and reasonably current account information.
• Maintaining the confidentiality of your account credentials.
• Protecting access to your account and device.
• Providing reasonably accurate information when requesting personalized recommendations.
• Using Mulhim in accordance with these Terms and applicable laws.

You may not:

• Use Mulhim for unlawful purposes.
• Attempt to gain unauthorized access to another account or Mulhim systems.
• Interfere with the security, integrity, availability, or operation of the Service.
• Upload malicious software, code, or content.
• Use automated methods to improperly scrape, extract, or copy Mulhim systems or content.
• Reverse engineer, reproduce, modify, distribute, resell, sublicense, or commercially exploit Mulhim except where expressly permitted by applicable law.
• Circumvent subscription, security, authentication, or usage restrictions.
• Misuse Mulhim's artificial intelligence or computer vision systems to harm another person or violate applicable law.

Mulhim may provide both free and paid functionality.

Access to certain features may require an auto-renewable subscription.

Before a user confirms a subscription purchase, Mulhim will display the applicable subscription information, including:

• Subscription title.
• Subscription duration.
• Subscription price.
• Applicable price information.
• Features or access included with the subscription.

Available subscription periods may include monthly and annual subscriptions.

The final price, currency, applicable taxes, subscription period, and other purchase information are displayed in the Apple purchase interface before the transaction is confirmed.

Subscriptions purchased through Apple's App Store may automatically renew at the end of the applicable subscription period unless the subscription is cancelled before renewal.

Payment for subscriptions purchased through the App Store is processed using Apple's In-App Purchase system and the user's Apple Account.

Apple manages payment processing and subscription billing for purchases made through the App Store.

The subscription price applicable to the user is displayed before purchase confirmation.

Users who purchase a subscription through Apple's App Store can manage or cancel their subscription through their Apple Account subscription settings.

Cancelling a subscription prevents future renewal.

Unless otherwise required by applicable law or Apple's policies, cancellation does not immediately remove access to subscription features already paid for, and access may remain available until the end of the current subscription period.

Deleting the Mulhim application does not automatically cancel an active Apple subscription.

Deleting a Mulhim account also does not automatically cancel an active App Store subscription.

Users are responsible for cancelling App Store subscriptions through their Apple Account when they no longer wish the subscription to renew.

Mulhim may occasionally offer eligible users a free trial, introductory offer, promotional price, or other subscription promotion.

Where such an offer is available, its:

• Duration.
• Eligibility conditions.
• Subscription price.
• Renewal conditions.

will be displayed before purchase.

Unless cancelled before the applicable renewal, a trial or promotional subscription may automatically continue as a paid subscription at the price shown during the purchase process.

Payments completed through Apple's App Store are processed by Apple.

Requests relating to refunds for App Store purchases are handled through Apple's applicable purchase and refund processes, subject to applicable consumer rights and law.

Mulhim's collection, use, processing, storage, and protection of personal information are described in the Mulhim Privacy Policy.

By using Mulhim, you acknowledge that information you provide to the Service will be handled in accordance with the Mulhim Privacy Policy and applicable privacy and data protection requirements.

Depending on the features used, users may provide Mulhim with information or content including:

• Account information.
• Fitness and activity information.
• Training history.
• Physical measurements voluntarily provided by the user.
• Goals and preferences.
• Nutrition records.
• Wellness information.
• Exercise images or videos.
• Feedback.
• Other information voluntarily submitted through the Service.

Users retain ownership of content they own.

By submitting content to Mulhim, you grant Mulhim the limited rights necessary to process that content for the purpose of providing, operating, securing, maintaining, supporting, and improving the Service, subject to the Privacy Policy and applicable law.

You represent that you have the right to provide any content submitted through your account.

Mulhim, including its software, interfaces, designs, branding, visual elements, algorithms, artificial intelligence systems, computer vision systems, databases, text, graphics, logos, trademarks, and other proprietary materials, is owned by or licensed to Mulhim and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of Mulhim intellectual property to users.

Except where permitted by law or expressly authorized by Mulhim, users may not reproduce, distribute, modify, sell, license, or commercially exploit Mulhim or its proprietary materials.

Mulhim may rely on or integrate third-party technologies and services, including infrastructure providers, artificial intelligence services, analytics services, payment systems, authentication services, cloud infrastructure, and other technology providers.

Users must comply with applicable third-party terms when using Mulhim.

Third-party services operate independently and may occasionally change, become unavailable, or experience technical interruptions.

Mulhim is not responsible for matters outside its reasonable control relating solely to independent third-party systems.

We aim to maintain a reliable Service, but we do not guarantee uninterrupted or error-free operation.

Mulhim may temporarily become unavailable because of:

• Maintenance.
• Technical failures.
• Network issues.
• Third-party service interruptions.
• Security updates.
• Infrastructure updates.
• App Store or operating-system requirements.
• Feature improvements or modifications.

We may update Mulhim where reasonably necessary for security, functionality, compliance, performance, or user experience.

Users may stop using Mulhim at any time.

Mulhim may suspend, restrict, or terminate access when reasonably necessary because of:

• A material violation of these Terms.
• Fraudulent activity.
• Abuse of the Service.
• Security threats.
• Illegal activity.
• Attempts to compromise Mulhim systems.
• Requirements imposed by law or a competent authority.

Termination of a Mulhim account does not automatically cancel an active App Store subscription.

To the maximum extent permitted by applicable law, Mulhim is provided on an "as available" basis.

Mulhim does not guarantee:

• A particular fitness result.
• A particular performance result.
• Weight loss or weight gain.
• A particular nutrition outcome.
• That every recommendation will be appropriate for every user.
• That AI outputs will always be accurate.
• That computer vision analysis will detect every movement or technique issue.
• That the Service will always operate without interruption or error.

Nothing in these Terms excludes warranties, rights, remedies, consumer protections, or liabilities that cannot legally be excluded under applicable law.

To the maximum extent permitted by applicable law, Mulhim and the Application Provider will not be liable for indirect, incidental, special, exemplary, or consequential losses resulting from use of the Service where such liability can legally be limited.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

Any mandatory consumer rights remain unaffected.

These Terms are governed by the applicable laws and regulations of the Kingdom of Saudi Arabia, subject to any mandatory consumer or other legal protections applicable to the user that cannot legally be waived.

Disputes relating to these Terms or the Service will be handled through the competent authorities or courts in accordance with applicable law.

Mulhim may update these Terms when reasonably necessary because of:

• New products or features.
• Changes to existing services.
• Legal or regulatory requirements.
• Privacy or security requirements.
• Changes to technology or operational practices.

Where required by applicable law, users will receive appropriate notice of material changes.

Continued use of Mulhim following the effective date of updated Terms constitutes acceptance to the extent permitted by applicable law.

You and Wadha Alsahli acknowledge that this End User License Agreement is concluded between you and Wadha Alsahli only, and not with Apple Inc. ("Apple").

Wadha Alsahli, and not Apple, is solely responsible for Mulhim and its content.

These Terms are not intended to establish usage rules that conflict with the applicable Apple Media Services Terms and Conditions or other applicable Apple usage rules.

You are granted a limited, non-exclusive, non-transferable license to use Mulhim on Apple-branded products that you own or control, subject to the applicable usage rules contained in the Apple Media Services Terms and Conditions.

Where permitted by Apple's applicable rules, the application may also be accessed and used through accounts associated with the purchaser through applicable Apple features such as Family Sharing, volume purchasing, or Legacy Contacts.

No ownership interest in Mulhim is transferred to you.

Wadha Alsahli, as the Application Provider, and not Apple, is responsible for providing maintenance and support services for Mulhim as required under these Terms or applicable law.

You acknowledge that Apple has no obligation to provide maintenance or support services for Mulhim.

The Application Provider is responsible for any warranties applicable to Mulhim, whether expressly provided or required by applicable law, to the extent that such warranties cannot legally be excluded.

If Mulhim fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the Licensed Application, if any.

To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Mulhim.

Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure of Mulhim to conform to an applicable warranty are the responsibility of the Application Provider to the extent required by applicable law.

You and the Application Provider acknowledge that Wadha Alsahli, and not Apple, is responsible for addressing claims relating to Mulhim or your possession or use of Mulhim, including:

• Product liability claims.
• Claims that Mulhim fails to comply with an applicable legal or regulatory requirement.
• Claims arising under consumer protection, privacy, or similar legislation.
• Where applicable, claims associated with the application's interaction with Apple frameworks such as HealthKit or HomeKit.

Nothing in these Terms limits the Application Provider's liability beyond what is permitted by applicable law.

If a third party claims that Mulhim, or your possession or use of Mulhim, infringes that third party's intellectual property rights, Wadha Alsahli, and not Apple, will be responsible for the investigation, defense, settlement, and discharge of the intellectual property infringement claim to the extent required by applicable law.

You represent and warrant that:

• You are not located in a country or region subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country or region.
• You are not listed on any United States Government list of prohibited or restricted parties.

When using Mulhim, you must comply with applicable third-party agreements and terms, including applicable Apple, internet service provider, mobile carrier, platform, device, and service-provider requirements.

You and the Application Provider acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of the Apple-specific provisions of this EULA.

Upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce the applicable provisions of this EULA against you as a third-party beneficiary.
